These Terms & Conditions ("Terms") govern your access to and use of aquapeutics.com (the "Site") and your purchase of products from Aquapeutics LLC ("Aquapeutics," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or purchase from us.

1. The company

Aquapeutics LLC is a family-owned manufacturer and retailer of luxury steam showers, saunas, whirlpool tubs, and walk-in tubs, based in Palmer, Massachusetts. Contact: (800) 290-6812, info@aquapeutics.com.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from us.

3. Products, pricing, and availability

We strive for accuracy, but product descriptions, images, specifications, and prices may contain errors and are subject to change without notice.
Prices are in U.S. dollars unless stated otherwise. Availability is not guaranteed; some items are special order or back-ordered.
We reserve the right to correct errors, update information, limit quantities, and refuse or cancel any order, including after it has been submitted.

4. Orders and acceptance

Your order is an offer to buy. We may accept or decline it. A confirmation email acknowledges that we received your order but does not guarantee acceptance. If we cancel an order after you have been charged, we will issue a refund.

5. Payment, taxes, and financing

Payment is processed through our secure checkout (Shopify) and its payment providers. We do not store your full payment card number.
Applicable sales tax is added where required (for example, Massachusetts sales tax on local pickups).
Financing through Affirm is subject to Affirm's approval and its own terms and privacy policy.

6. Shipping and delivery

Shipping terms, fees, and limitations — including free freight to the contiguous United States and the additional fee for Canadian orders — are described on our Shipping & Returns page, which is incorporated into these Terms by reference. Inspect your delivery on arrival, note any damage, and report delivery damage to us promptly.

7. Returns and refunds

Returns are governed by our Shipping & Returns policy, which is incorporated into these Terms by reference. In summary: you must contact us within 30 days of purchase; obtain a Return Material Authorization (RMA) before shipping anything back; return items new and unused in their original packaging; pay return shipping; and a 15% restocking fee applies. Refunds are issued after the returned item has been received and inspected.

8. Warranty

Our products include a 5-year structural warranty and a 1-year parts warranty, with an optional Lifetime Parts Warranty upgrade available at purchase. Warranty details, coverage, and exclusions are described on our Warranty Policy page, which is incorporated into these Terms by reference. EXCEPT AS EXPRESSLY STATED IN OUR WARRANTY, PRODUCTS ARE PROVIDED WITHOUT OTHER WARRANTIES, AND WE DISCLAIM ALL IMPLIED WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Installation and safe use

Our products require proper installation and electrical and plumbing connections. You are responsible for ensuring that installation is performed by licensed, qualified professionals in accordance with the product manual and all applicable building, electrical, and plumbing codes. Improper installation, modification, misuse, or failure to follow the product manual can create safety hazards and may void the warranty. Aquapeutics is not responsible for installation work or for damage or injury resulting from improper installation or use.

10. Intellectual property

The Site and its content — text, images, logos, product designs, and graphics — are owned by or licensed to Aquapeutics and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from them without our prior written permission.

11. Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping content, or using it for any unlawful purpose.

12. Third-party links and services

The Site may link to third-party websites and services (such as Affirm and shipping carriers). We are not responsible for their content, products, or practices.

13. Disclaimer

The Site is provided "as is" and "as available." We do not warrant that the Site will be uninterrupted, error-free, or secure.

14. Limitation of liability

To the fullest extent permitted by law, Aquapeutics and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to the Site or the products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Aquapeutics from any claims, damages, losses, and expenses arising out of your violation of these Terms or your misuse of the Site or products.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms, the Site, or your purchases will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.

17. Changes to these Terms

We may update these Terms from time to time. The "Effective date" above shows when they were last revised. Your continued use of the Site or any purchase after changes take effect means you accept the updated Terms.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the policies incorporated by reference (Shipping & Returns, Warranty Policy, and Privacy Policy), are the entire agreement between you and Aquapeutics regarding the Site and your purchases.
